You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account.
You agree to use Querygen only for lawful purposes and in accordance with these Terms of Use. You must not misuse the service in any way that could harm others or the functionality of Querygen.
All intellectual property rights in Querygen, including but not limited to software, content, and trademarks, are owned by or licensed to us. You may not reproduce, distribute, or create derivative works from any part of the service without prior written permission.
Your use of Querygen is also governed by our Privacy Policy, which details how we collect, use, and protect your data. By using the service, you consent to the collection and use of your information as described in the Privacy Policy.
Querygen is an independently developed, unofficial tool intended for businesses to automate their operations through WhatsApp. We are not endorsed, supported, or associated with WhatsApp™, Meta™, Telegram™, or any of their affiliates or subsidiaries. The use of Querygen may potentially be in violation of WhatsApp's Terms and Conditions, and we assume no responsibility for any actions taken by WhatsApp or Meta against users of our tool.
Users understand and agree that their accounts and/or phone numbers could be blocked or banned by WhatsApp's, Meta's, or Telegram's automatic anti-spam systems at any time. Querygen is not responsible for such blocking or banning, nor for any inability to access our service, API, accounts, etc., due to user's equipment, software, or internet channel failures.
We are not liable if users are unable to access the service or API due to changes in software implemented by WhatsApp™, Meta™, Telegram™, or any other third-party messaging platform.
We cannot guarantee uptime or business continuity for this service. Users agree to use the service 'as is', and accept that it may become temporarily unavailable due to updates to WhatsApp's web version, Telegram updates, or other changes implemented by third-party platforms.
We do not bear responsibility for any business losses incurred during periods of service unavailability and do not provide refunds for such periods.
To the fullest extent permitted by law, Querygen and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the service.
In no event will Querygen be liable for any special, indirect, incidental, exemplary, or consequential damages of any kind arising out of or in connection with the use of our service or any other service and/or content included or made available through our service, regardless of the form of action, whether in contract, tort, strict liability, or otherwise. Our total liability for all causes of action and under all theories of liability will be limited to the amount you paid to Querygen.
By using our service, you accept responsibility for all legal and financial consequences resulting from your use. This includes defending, indemnifying (covering the cost of), and holding us harmless from any and all expenses we may incur as a result of claims or demands from third parties. These expenses may include attorneys' fees, costs, penalties, interest, and other disbursements. Such claims may arise from your use of the service, any person using your account's use of the service, any violation of applicable laws or regulations, any infringement of third-party rights, or any breach of these terms by you.
We reserve the right to terminate or suspend your access to Querygen at our sole discretion, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users or the service itself.
Please refer to our Cancellation and Refund Policy for details on subscription cancellations and refund eligibility. Note that refunds are not provided for service downtime or platform-related issues beyond our control.
These Terms of Use shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
We may update these Terms of Use from time to time. You are encouraged to review the terms periodically to stay informed of any changes. Your continued use of Querygen after any modifications indicates your acceptance of the updated terms.
